What are narcotics in the UAE Anti-Narcotics Law:

Narcotics are any natural or compound substance listed by the law in its attached schedules to Law No. 1, 2, 3, 4 attached to the UAE Anti-Narcotics Law.

There are psychotropic substances, which are every substance, whether natural or compound, that are listed in Schedules 5, 6, 7, and 8 of the UAE Anti-Narcotics Law.

Import and it means bringing substances that have a narcotic or mental effect into the country while exporting is taking out the substances that have a narcotic or mental effect out of the country, and the word “fetch” means bringing these substances from outside the country,

and the word “transport” is a process of transportation These substances are either within the country from one place to another or using transit, and there is the term production and it means the process of separating narcotic or psychotropic substances from their plant origin. As for the administratively competent authority, it is determined by a decision of the Minister of Health.

Import and export of narcotics and psychotropic substances in the UAE Anti-Narcotics Law:

The Federal Law of the United Arab Emirates allocated an entire law containing chapters and articles to laws related to drug control in the Emirates and separated all issues whether these substances are narcotics or have a mental effect. All of this came in Law No. 14 of 1995 and was amended by Law 1 in 2005 AD And Cabinet Resolution No. 15 in 2011, in which it specified and separated the attached tables in Federal Law No. 14.

The UAE Anti-Narcotics Law specified in its articles some chapters related to import, import, and export, or even the manufacture, separation, and production of narcotics and psychotropic substances specified in the law.

Except for medical uses that are subject to control or if scientific research is conducted on those substances, and that is with the knowledge of a scientific authority specialized in that and has a decision from the Council of Ministers according to the proposal of the Minister of Health, which determines the provisions related to it and its activities, and in each, The cases may not exceed the weights specified in the anti-narcotics law in the Emirates.

The Minister of Health directs the inspection of the permitted materials according to specific conditions unless the appropriate action is taken in the event of a violation, and all this is done with written permissions.

And for your information, written permission is not prohibited except for the authorities permitted by the anti-drug law in the UAE, and they are as follows:

  • Government agencies and recognized institutes.
  • Governmental hospitals and clinics, as well as not forgetting the government clinics.
  • In chemical analysis laboratories, as well as medical and industrial research, which have obtained licenses.
  • Do not forget about drug stores and pharmacies, as well as factories for medical supplies that are licensed, but provided that the pharmacist has a license to practice the profession.
  • The offices of intermediaries and agents of pharmaceutical and medical preparation companies and factories have licenses to practice the profession, and the condition for that is the use of a responsible pharmacist who has a license to practice the profession.

And the permission is issued only in the name of the director of the authority or responsibility for it, and it is based on the request that was submitted by him and signed by him, and all this on the form prepared by the competent administrative authority.

The previous permission may not be granted in the UAE Anti-Narcotics Law for the following persons:

  • If he has been convicted of a crime involving moral turpitude or dishonesty, whether it is imprisonment or flogging.
  • Convicted of any of the crimes in the UAE Anti-Narcotics Law.
  • Whoever has been convicted of a crime, whether it is a crime related to money, honor, morals, suspicion, or attempt to do one of these things
  • Whoever was previously dismissed for reasons of dishonor or dishonesty, unless three years have elapsed since his dismissal.

Special records in which the permits issued for the import and export of narcotics or psychotropic substances are registered in the UAE Anti-Narcotics Law:
The record containing the permissions must include the following:

  • The authorized person’s name, capacity, and personal data from the date of birth, nationality, and residence.
  • The given ear date and number.
  • The type of materials and their quantities, whether in letters or numbers.
  • The place where the materials were deposited.
  • The registration number in the commercial register is required, and this is specific to the entities whose records must be specified in this register.

Import and export permits are considered canceled if they are not used within sixty days from the date on which they were issued.

And in the matter of pharmacies, they are not entitled to dispense any narcotic or psychotropic substance unless a prescription is found from a specialized doctor who has a license to practice the profession in human or veterinary medicine in the country unless it is considered contrary and at the same time it must not exceed the prescribed and stipulated dose In the pharmacopeia,

If the patient needs an increase, the attending physician must request permission from the competent authorities. Pharmacies are prohibited from dispensing narcotic substances to the patient more than once.

Production of narcotics or psychotropic substances, manufacture of medical preparations containing them, and their use in treatment in the UAE Anti-Narcotics Law:

All pharmaceutical factories or pharmacies may not manufacture a preparation containing a narcotic or psychotropic substance except after obtaining the license stipulated in the law and on its specific conditions.

Also, these authorities are not entitled to use the materials except in the manufacture of the preparations they produce.

It is not permissible to exceed the percentages specified for pharmaceutical factories and pharmacies

Plants prohibited in the UAE Anti-Narcotics Law, which contain narcotics and psychotropic substances:

It is prohibited for any person to bring, import, or even possess or use the plants mentioned by the law attached to the Anti-Narcotics Law in the Emirates, and any landowner must inform the public authorities about the plants if they are among the plants whose cultivation is prohibited as soon as he knows.

The Minister of Climate Change and Environment is the one who grants the licenses that government agencies and scientific institutes want to grow any plant whose cultivation is prohibited.

Penalties in the UAE Anti-Narcotics Law or Anti-drug law in the UAE:

  • A person shall be sentenced to imprisonment for no less than two years for any person who abused in any way or possessed a drug for abuse, or personal use, other than in the places licensed in the anti-drug law in the Emirates, and the court has the right to fine the convict a fine of no less than ten thousand dirhams with imprisonment.   • Anyone who takes or possesses a narcotic or psychotropic substance, or even if it is a narcotic plant and is other than the attached substances, shall be sentenced to imprisonment for a period not exceeding one year.
  • There is a case in which, of course, the court may, in other than the case of a return, instead of a prison sentence and fines, rule as follows: 

The offender is placed in one of the addiction treatment units, and this can only be done after consulting the opinion of the appointed committee supervising the center, and it must submit a report every six months, and if it is asked to submit a report, it must submit a report on the condition of the convicted person.

In the anti-narcotics law in the UAE, no criminal case is filed against the abuser if he, his wife, or one of his relatives submits to the addiction treatment unit and asks for his treatment, so he is deposited until the decision is made in the unit to release him, and if the deposit is through the Public Prosecution, the body that deposited him must:

The approval of the Public Prosecution is taken to release him, or if he does not adhere to the treatment plan, or if he still has hidden narcotic substances, and at that time he must take the necessary action to file a criminal case. In all cases, the treatment and rehabilitation period for the convicted person does not exceed two years. He passed the treatment program.

A sentence of imprisonment for no less than five years in addition to a fine of no less than twenty thousand dirhams shall be imposed on whoever calls for or acts to personally incite the commission of any of the crimes in the anti-drug law in the Emirates or works to facilitate its perpetration, and it is considered an aggravating circumstance that the occurrence of crime, incitement to it, or facilitating it.

A fine of no less than fifty thousand dirhams shall be imposed on anyone who manufactures, imports, sells, or brings narcotic or psychotropic substances with the intention of promoting, whether they are goods, publications, or even pictures, drawings and writings that incite the commission of crimes related to narcotics and psychotropic substances. Publications are confiscated in all cases.

If the offender committed these crimes to harm the one who committed the crime before him, and as a result of that harm occurred to him, he shall be punished with imprisonment for no less than seven years and a fine of no less than twenty thousand dirhams, and if the harm is serious, the penalty is imprisonment for not less than ten years and not more than fifteen years, and a fine of not less than twenty thousand dirhams, and the death penalty is imposed if the crime results in the death of the victim.

Inserting drugs into the UAE anti-drug law:

If a person inserts drugs into someone’s drink or food or even makes him use it without his knowledge, he shall be punished by imprisonment for no less than five years.

If one of them puts drugs in someone’s drink or food or even makes him use them without his knowledge and with intent, he shall be punished by imprisonment for no less than seven years.

If someone puts drugs in someone’s drink or food, and the result is that he became addicted to intent, he shall be punished with life imprisonment.

If one of them put drugs in someone’s drink or food, and the result was that the victim died, he shall be punished by death.

Anyone who forces another person to use narcotics or psychotropic substances shall be punished with life imprisonment.

Whoever prepares or prepares a place for the consumption of narcotic substances and referred to in schedules No. 1, 2, 4, and 5 shall be punished with imprisonment for no less than ten years and not more than fifteen years, and he shall also be sentenced to a fine of not less than twenty thousand dirhams. A sentence of imprisonment for not less than six months and not more than a year and a fine of not less than ten thousand dirhams and not more than twenty thousand dirhams shall be imposed on anyone who is caught in any of the places referred to in the previous article while being aware of it.

In the case of committing a drug seizure crime and the intent is trafficking or promotion, the penalty is death.

If the crime is committed with intent to trade or promote, the penalty shall be death.

The punishment is imprisonment for not less than seven years and not more than ten years, and a fine of not less than fifty thousand dirhams and not more than two hundred thousand dirhams shall be passed for anyone who brings, imports, exports, works on manufacture, extraction, separates and produces Any of the articles stipulated in the law in Tables 3, 6, 7 and 8 of the UAE Anti-Narcotics Law.

Anyone who possesses or keeps any of the articles of the previous clause shall be sentenced to imprisonment for not less than one year and not exceeding three years, and a fine of not less than twenty thousand dirhams and not more than fifty thousand dirhams.

And if the crimes in the previous two clauses occurred with the intention of trafficking and promotion, the penalty is life imprisonment and a fine of not less than fifty thousand dirhams and not more than two hundred thousand dirhams, and in the case of a return, he is sentenced to death.
